The Notification of 3.3.49 which conferred this right of extension was unconditional and fixed no time limit within which leaseholders should apply for a formal deed of extension, nor to the best of my knowledge has any such time
limit ever been fixed since. Under these circumstances the fact
that they had not applied for such formal deeds when the new
system was introduced would not in my opinion deprive them of
their existing rights any more than it would lessees who had
purchased for 999 years a few months before the change and had
not taken up their Crown Leases when the new system came into
force.
Comparatively few of the lessees applied for
deeds of extension in 1849 and the records of this office shew
that these deeds have been frequently applied for and granted
during the last sixty years and even now there are several
who
have not applied. The number entitled to this privilege is limit-
-ed of course by the G.N. to *all Crown Leases heretofore grant-
